Data controller

Bottles With History ApS is the data controller for the processing of the personal data we receive about you.

What data we process

Contact and delivery details: name, address, email and telephone number.
Order details: what you have bought, price, payment method, delivery and any returns and complaints.
Payment details: payments are handled by our payment providers. We do not see or store your full card number.
Age verification: information that you meet the age limit.
Enquiries: the content of your messages to our customer service and in the chat on the website.
Marketing: your email address and your preferences if you sign up for our newsletter, and whether you open and click on our emails.
Technical data: IP address, device, browser and your use of the website, collected via cookies and similar technologies.

Purposes and legal basis

To process your order, deliver the item, handle returns and complaints and respond to your enquiries. Legal basis: performance of the contract with you (Article 6(1)(b) of the General Data Protection Regulation).
To comply with legal requirements, e.g. the Danish Bookkeeping Act and the rules on age limits for the sale of alcohol. Legal basis: legal obligation (Article 6(1)(c)).
To send newsletters and other marketing by email. Legal basis: your consent (Article 6(1)(a)). You can unsubscribe at any time via the link in our emails.
Statistics, analysis and targeted advertising via cookies. Legal basis: your consent (Article 6(1)(a)).
To prevent fraud, secure our systems and invite you to review your purchase on Trustpilot. Legal basis: our legitimate interest (Article 6(1)(f)).

Who we share data with

We use trusted suppliers (data processors), who may only process your data on our instructions and under a data processing agreement:

Webshop and payment: Shopify (incl. Shopify Payments).
Delivery and returns: Shipmondo and UPS.
Age verification: the carrier, when ID is checked on delivery.
Email and customer service: Klaviyo, Missive and Microsoft 365.
AI: Anthropic (Claude), which is used in the chat and the gift assistant on the website and to help answer customer enquiries.
Reviews: Trustpilot, which sends invitations to review your purchase.
Statistics and advertising (only with your consent): Google, Meta, Microsoft Clarity, Lucky Orange, ProfitMetrics and Daisycon.

Klarna and PayPal are independent data controllers for the data they process when you pay with them. Trustpilot is an independent data controller for the reviews you write.

We also share data with authorities, our auditor and our insurance company when necessary or required by law.

Transfers to countries outside the EU/EEA

Some of our suppliers, including Shopify, Klaviyo, Google, Meta, Microsoft and Anthropic, may process data in the USA or Canada. Such transfers are based on the European Commission's adequacy decisions (including the EU-US Data Privacy Framework) or the European Commission's standard contractual clauses.

Retention

Order and accounting data are kept for 5 years from the end of the financial year to which they relate, in accordance with the Danish Bookkeeping Act.
Other customer data and enquiries are deleted no later than 2 years after the end of the customer relationship.
Newsletter data are kept until you unsubscribe.

Cookies

We use necessary cookies that make the webshop work, e.g. the cart and checkout. With your consent, we also use cookies for statistics and marketing, including from Google, Meta, Microsoft Clarity, Lucky Orange, ProfitMetrics and Daisycon. Microsoft Clarity and Lucky Orange record how the website is used, e.g. clicks and scrolling, so that we can improve it.

We obtain your consent via Shopify's cookie banner the first time you visit the website. You can change or withdraw your consent at any time via the cookie settings on the website.

Security

We protect your data with technical and organisational security measures. Order data are stored encrypted with Shopify, and only employees with a work-related need have access to them.

Age limit

We do not sell to persons under the age limit and do not knowingly collect data about children.

Your rights

Right of access to the data we process about you.
Right to have inaccurate data rectified.
Right to have your data erased, unless we are obliged to retain them, e.g. under the Danish Bookkeeping Act.
Right to restriction of processing.
Right to data portability, i.e. to receive your data in a commonly used, machine-readable format.
Right to object to processing based on our legitimate interest. You can always object to direct marketing.
Right to withdraw your consent. This does not affect the lawfulness of processing carried out before the withdrawal.

Complaints

You can lodge a complaint about our processing of your personal data with the data protection supervisory authority in your country. You can also complain to Datatilsynet in Denmark, Carl Jacobsens Vej 35, 2500 Valby, telephone +45 33 19 32 00, www.datatilsynet.dk.
